Can I dismiss an employee before the probation period is complete?

Yes. As a general rule, you should aim to assess the employee’s suitability over the entire probation period, but this is not a hard and fast rule. If at any point during the probation it becomes apparent that the employee cannot perform to the required standard, you may terminate the employee’s services. But, you should ensure that you comply with the provisions of the Code of Good Practice: Dismissal which is set out in the Labour Relations Act. You should give the employee any necessary instruction or training. You should also advise the employee of any under-performance, and give them an opportunity to show cause (an informal hearing) why their services should not be terminated on grounds of under-performance.
