An employee is certainly entitled to be paid out for accrued leave not taken during the current leave cycle. There is some uncertainty as to whether that entitlement extends to leave accumulated during previous leave cycles. For clarity, employment contracts should include a provision to the effect that leave must be taken during each leave cycle, and that leave not taken will be forfeited. Also ensure that employees actually take their leave when it becomes due. Leave forms should be completed and retained - administration is critical.
